Terms of Service

1. What this covers

These terms govern your use of Rowbot ("the platform"), a club management application operated by Experiential Technologies Ltd ("we", "us", "our"), a company registered in England and Wales (Company No. 12585767).

By creating an account or using Rowbot, you agree to these terms.

2. The platform

Rowbot is a software platform that helps rowing clubs manage their operations — members, schedules, equipment, and more. We provide the software; your club decides how to use it.

We are not a party to the relationship between you and your club. Your club membership, fees, and obligations are between you and your club.

3. Accounts

You need an account to use Rowbot. When you create one:

• You must provide accurate information
• You are responsible for keeping your login credentials secure
• You must not share your account with others
• You must notify us if you suspect unauthorised access

Your access to a club's data within Rowbot is controlled by that club's administrators. If your club removes you, you will lose access to that club's data but your Rowbot account will remain active.

4. Club administrators

If you are a club administrator, you are responsible for:

• How your club uses Rowbot and the data entered into it
• Ensuring you have a lawful basis to process your members' data (see our Privacy Policy)
• Managing user access and permissions within your club
• Informing your members about how their data is used

Your club is the data controller for member data stored in Rowbot. See our Privacy Policy for details.

5. Acceptable use

You agree not to:

• Use Rowbot for anything unlawful
• Attempt to access another user's account or another club's data
• Interfere with or disrupt the platform
• Scrape, crawl, or automatically extract data from the platform
• Upload malicious content or code
• Use the platform in a way that could harm other users or clubs

We may suspend or terminate your account if you breach these terms.

6. Content and data

You (and your club) retain ownership of all data entered into Rowbot. We do not claim any intellectual property rights over your content.

We will not access your club's data except to:

• Provide and maintain the service
• Respond to support requests
• Comply with legal obligations
• Investigate potential violations of these terms

You can request an export of your club's data at any time by contacting us. If you delete your account, your personal account data will be removed within 30 days. Club data is managed by your club's administrators.

7. Fees and payment

Rowbot may be offered free of charge or under a paid plan, depending on your club's arrangement with us.

If your club is on a paid plan:

• Fees will be agreed in writing with your club
• We will give at least 30 days' notice of any price changes
• Non-payment may result in suspension of access

Individual members are not directly billed by Rowbot. Any membership fees your club charges you are between you and your club.

8. Availability and support

We aim to keep Rowbot available and reliable, but we do not guarantee uninterrupted access. The platform may be temporarily unavailable for maintenance, updates, or reasons beyond our control.

We provide support on a reasonable-efforts basis. We are a small team and response times may vary.

9. Intellectual property

The platform and its original content, features, and functionality are owned by Experiential Technologies Ltd and are protected by applicable intellectual property laws.

10. Liability

To the maximum extent permitted by law:

• Rowbot is provided "as is" without warranty of any kind, express or implied
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform
• Our total liability to you for any claim is limited to the fees you (or your club) have paid us in the 12 months prior to the claim, or £100, whichever is greater
• We are not liable for any decisions made by your club using data in Rowbot, or for any loss of data caused by circumstances beyond our reasonable control

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

You can delete your account at any time. If you are a club administrator, contact us to discuss winding down your club's use of the platform.

We may suspend or terminate your account if you breach these terms, with reasonable notice where possible. If we discontinue the platform entirely, we will give at least 90 days' notice and assist with data export.

On termination, your right to use Rowbot ends. We will handle your data in accordance with our Privacy Policy.

12. Changes to terms

We may update these terms from time to time. We will notify you of significant changes via email or an in-app notice. Continued use after changes constitutes acceptance of the new terms.

13. General

• Governing law: These terms are governed by the laws of England and Wales.
• Disputes: Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
• Entire agreement: These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Rowbot.
• Severability: If any part of these terms is found unenforceable, the rest remains in effect.
